Introduction
Welcome to mytown.ie, your local community online. By using the mytown.ie service you accept and agree to be bound by the following terms and conditions. Where applicable under law, these Terms constitute a 'writing signed by you.'
Changes to mytown.ie and the Terms of Service
We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Service at any time without further notice. If we do this, we will post the changes to these Terms of Service on this page and we may send registered users an email notifying you of the change.
Eligibility and Registration
You should provide true, accurate and complete registration information to be a mytown.ie member. As part of the registration process, you will be asked to select a username and password and you will be responsible for all activities occurring under your username and for keeping your password secure. We may refuse to grant you a username that impersonates someone else, is or may be protected by trademark or proprietary rights law, or is vulgar, offensive or otherwise inappropriate, as determined by us in our sole discretion.
Member Conduct and Appropriate Content
You may not use the mytown.ie Service for any illegal or unauthorized purpose. International users agree to comply with all local rules regarding online conduct and acceptable content. You are solely responsible for your conduct and any data, text, information, graphics, photos, profiles, audio and video clips, links and other content ('Materials') that you submit, post, and display on the mytown.ie Service.
Mytown.ie will attempt to remove any objectionable user generated content from the site, but it is imposible to review all user generated content. This content expresses the views of the author/user and mytown.ie will not be held responsible for this content.
We may, but shall have no obligation to, remove Materials that we determine in our sole discretion are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any party's intellectual property or other proprietary rights or these Terms of Service. Further, under no circumstances does mytown.ie have any obligation to check the accuracy or truthfulness of the any Materials, nor to monitor any Member's use of the mytown.ie Service.
CONDITIONS FOR USE
You agree to abide by all applicable Irish and international laws and regulations and are solely responsible for all acts or omissions that occur under your account made by you including the content of your transmissions through the mytown.ie Service. By way of example, and not as a limitation, you agree NOT to:
* Publish, distribute and/ or disseminate any harmful, obscene, indecent, unlawful, libelous, profane, defamatory, infringing, inappropriate, hateful, or racially, ethnically or otherwise objectionable material or information.
* Submit Materials that are unlawful or promote or encourage illegal activity or that would violate the property rights of others.
* Submit Materials of any third party without such third party's prior written consent, or Materials that falsely express or imply that such Materials are sponsored or endorsed by mytown.ie
* Create a false or misleading, or falsely state or otherwise misrepresent your affiliation with a person or entity.
* Transmit, email or post any material that contains in any form software viruses or such programs as including but not limited to, Trojan horses, worms, time bombs, cancel-bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
* Use the mytown.ie Service in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website.
* Attempt to gain unauthorized access to the mytown.ie Service, other accounts, computer systems or networks connected to the mytown.ie Service, through password mining or any other means.
* Modify, adapt, translate, or reverse engineer any portion of the mytown.ie Service, or use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion or the mytown.ie Service.
* Reformat or frame any portion of the web pages that are part of the mytown.ie Service.
* Disseminate content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary right of any party or infringes any intellectual property law or any other applicable law.
* Remove any copyright, trademark or other proprietary rights notices contained in or on the mytown.ie Service.
* Disseminate any unsolicited or unauthorized advertising, promotional materials, 'junk mail', 'spam', 'chain letters', 'pyramid schemes', or any other form of such solicitation.
* Interfere with another Member's use and enjoyment of the mytown.ie Service.
* Harvest or collect email addresses or other contact information of Members, including usernames, from the mytown.ie website by electronic or other means.
* Data from mytown.ie may not be used expressly for Telesales, Mailshots or any other commercial use without express permission in writing from mytown.ie.
Advertising, Paid listings and printed promotions
Businesses advertising with mytown.ie agree to terms and conditions within this page.
Businesses can request for their listing to be removed from appearing on mytown.ie by making a clear and formal request as such to a member of the mytown.ie team.
Businesses paying to have a listing appear on mytown.ie are responsibile for the posting and updating of their own listing through the login details created or provided to them by a mytown.ie representitive. Businesses paying for listings should make an annual payment as agreed with mytown.ie on initial payment. If a payment is not made by the 364th day since the listing has been activiated, the listing will automatically be removed from mytown.ie.
The payment is an annual fee and may increase year on year.
All discounts that are listed on the mytown.ie website or referred to in advertising material must be provided to users on request.
It is entirely your resonsibility to ensure that any details you provide to mytown.ie are correct before they are sent for printing as defects in print materials cannot be remedied thereafter and for the avoidance of any doubt whatsoever responsibility for ensuring the same rests solely with you.
Mytown.ie maintain the right to edit or remove any business listings.
Free business listings
Free listings are featured on mytown.ie to allow our users to find what they are looking for. Free listings can be entered by our users or members of our team. Free listings allow Irish based businesses to display their contact details.
Businesses can request for their listing to be removed from appearing on mytown.ie by making a clear and formal request as such to a member of the mytown.ie team.
By listing your business on mytown.ie you are confirming that details entered are accurate to the best of your knowledge. Free listings cannot feature any html or internet address information. Users should enter an individual business to the business listings once, duplications for any reason is not allowed.
By adding a listing to mytown.ie, you are agreeing to allow mytown.ie to use your website or an other web content produced by your business to further promote your business on mytown.ie.
All discounts that are listed on the mytown.ie website or referred to in advertising material must be provided to users on request.
Mytown.ie maintain the right to edit or remove any free business listings.
Proprietary Rights
Mytown.ie does not claim any ownership rights in any Materials that you submit, post, or display on or through the mytown.ie Services or on the mytown.ie Web site. After submitting, posting or displaying Materials on or through the mytown.ie website, you continue to retain all ownership rights in such Materials, and you continue to have the right to use your Materials in any way you choose. By submitting, posting or displaying any Materials on or through the mytown.ie website, you hereby grant to mytown.ie a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Materials solely on and through the mytown.ie website.
Without this license, mytown.ie would be unable to provide the mytown.ie Service. The license you grant to mytown.ie is non-exclusive (meaning you are free to license your Materials to anyone else in addition to mytown.ie), fully-paid and royalty-free (meaning that mytown.ie is not required to pay you for the use on the mytown.ie Service of the Materials that you post), sub licensable (so that mytown.ie is able to use its affiliates and subcontractors such as Internet and WAP content delivery networks to provide the mytown.ie Service), and worldwide (because the Internet and the mytown.ie Service are global in reach). This license will terminate at the time you remove your Materials from the mytown.ie Service
mytown.ie and its affiliates and licensors own and retain all rights in the mytown.ie Web site and mytown.ie Service, which contain proprietary and confidential information that is protected by applicable intellectual property and other laws, including without limitation all (1) text, (2) software, (3) photographs, (4) graphics, (5) page layout, and (6) design presented through and as part of the mytown.ie website. Except as expressly authorized by mytown.ie, you may not copy, modify, publish, transmit, distribute, perform, display or sell any of mytown.ie’s proprietary information.
Gallery Images
In extension to the propietary rights mentioned above, mytown.ie reserves the right to remove any images uploaded to its gallery by users. Users should only upload images that promote the town and its surrounding. If users abuse the gallery upload by uploading obsene, irrelevant, or commercial images - these images will be removed.

Copyright Policy
You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. mytown.ie respects the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement or are aware of any infringing material on the Web site, please contact us and provide us with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Web site (including a URL and/or screen shot); your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Internet/WAP Access
mytown.ie shall not be responsible for any connection or access to the mytown.ie website by you or the quality of the transmission of any information passing between you and the website.
Termination of the mytown.ie Service
These Terms of Service will apply to your use of the mytown.ie Service. At any time, you can terminate by emailing mytown.ie. Our proprietary rights, disclaimer of warranties, indemnities, limitations of liability and miscellaneous provisions shall survive any termination of your membership.
mytown.ie may also, in its sole discretion and at any time, discontinue temporarily or permanently providing the mytown.ie Service, or any part thereof, with or without notice. You agree that any termination of access to the mytown.ie Service under any provision of the Terms of Service may be effected without notice, and acknowledge and agree that mytown.ie may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the mytown.ie Service. Further you agree that mytown.ie shall not be liable to you or any third party for any termination or suspension of access to the mytown.ie Service or modification of the mytown.ie Service.
Termination of listing or advertising with mytown.ie
By registering to appear on mytown.ie business listings, you are effectively signing a 12 month contract to have the business details you have entered appear on mytown.ie. Your listing can be removed from the site 30 days after your request has been made; refund of subscription fees are not provided.
Disclaimer of Warranties
mytown.ie. and its affiliates, licensors, partners, members, suppliers, employees, consultants and agents disclaim any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or Materials displayed on the mytown.ie website.
mytown.ie further expressly disclaims (1) that the mytown.ie Service will meet your requirements and will be uninterrupted, error-free, timely, or secure, (2) that defects or errors will be corrected, (3) that the mytown.ie Service or the server that makes it available are free of viruses or other harmful components, and (4) that the use of or the results of the use of the mytown.ie Service or the content made available as part of the mytown.ie Service will be correct, accurate, timely, or otherwise reliable.
mytown.ie expressly disclaims any and all responsibility and liability for the conduct of any other Member, and expressly disclaims that the content and Materials of the mytown.ie Service input by other Members is correct or accurate.
Limitation of Liability
You agree to use the mytown.ie service entirely at your own risk.
Mytown.ie always tries to ensure that business users of the Site are reputable and of the highest quality but cannot make any warranties or representations or provide any form of guarantee we do not endorse any particular provider of any goods and/or services in that regard.
Mytown.ie is a facilitator only and is never involved in any transactions between the user of the site and businesses that advertise on it and as such has no control over the content or the delivery of the services to be provided by the businesses and consequently, mytown.ie makes no representations about the same or the results to be obtained from using any of the services so advertised and therefore the use of the mytown.ie website is entirely at the risk of the user.
Mytown.ie shall not be liable to you whether in contract, tort (including negligence) or otherwise, for:
any indirect, consequential or special loss or damage whatsoever;
any loss of profit, loss of anticipated savings, loss of business, loss of goodwill, loss of data or other such financial or business loss or damage; or
any other loss or damage in an amount exceeding €50.00 (fifty Euro) in the 12 months preceding the date on which such liability arose.
Notwithstanding the above provisions of this clause mytown's liability will not be limited in the case of its fraud or for death or personal injury caused by our negligence.

mytown.ie may provide you with notices regarding the mytown.ie Service or these Terms of mytown.ie Service by regular mail, email, or postings to this Web site.
Legal Compliance
You shall comply with all applicable domestic and international laws, statutes, ordinances, regulations, contracts and applicable licenses regarding your use of the mytown.ie Services.
